    MD; "In the name of God amen. I JOHN STOCKTON of Cecil County and state of
    Maryland, being sick and frail of body but of sound and disposing mind and
    memory, thanks be to God. Do make and ordain this my last will and testament
    in manner and form following. First I commend my sould to almighty God who
    gave it and my body to be earthly inturned at the disgreshon of my executor
    hereafter mentioned and as to such worldly estate as has pleased God to help
    me with I give and disposse of in the following manner.  I give and bequeath
    unto my loving wife Elizabeth Stockton after my just debts and funeral charges
    are paid the use and benifit of all the estate I may die possing of both real
    and personal during her widowhood in leau of her shares of my estate.  I give
    and bequeath unto my loving son JOHN STOCKTON, in case my wife should marry or
    at her death which shall firsst happen the sum of 700 pounds specis rating
    silver dollars and seven shillings and six pence each and ... half Johannes's
    at three pounds each to be paid by my executors hereafter mentioned in form of
    equal and annual payments to commencs from the time my wife marries or dies
    and also I give my said son all the negros and other articals I have hereto-
    fore let him have in full for his share of my estate.  I give and bequeath
    unto my loving daughter ELIZABETH STOCKTON in case my wife should marry or at
    her death which shall first happen the sum of 500 pounds (specis rating)
    silver dollars and 7 shillings and 6 pence and ... half Johanne's ar 3 pounds
    each to be paid by my executors herreafter mentioned in form equal and anual
    payments to commence from the time my wife marries or dies in full for her
    share of my estate. I give and bequeath unto my loving son JOSEPH STOCKTON and
    to his heirs and assigns forever all my estate both real and personal in case
    my wife should marry or at her death which shall first happen my said son
    JOSEPH STOCKTON paying unto his brother and sister the several sums of money
    bequeathed them at the time of payments mentioned.  Lastly I do hereby
    constitute and appoint my loving son JOSEPH STOCKTON whole and sole executor
    of this my last will and testament hereby revoking and making void all former
    or other will or wills heretofore by me made. Publishing and declaring this to
    be my last will and testament in testamony whereof I have here unto set my
    hand and seal this 29th day of January in the year of our Lord one thousand
    seven hundred and eighty two.  Signed, sealed, published and declared by the
    testator to be his last will and testament in the presents of us who subscribe
    our names at witnesses ... in his presents and at his request.  JOHN WARD,

John married in 1745. using the usual age of 25 for marriage, he would have
    been born c1720; allowing for his trips to Maryland and back to PA as he did,
    he may have married later, and to fit with his siblings was b c1718
CLIFF NEILSON, 3703 MOSS BROOKE CT., FAIRFAX, VA 22031; "Accounting of the
     Estate of John Stocton and Elizabeth his wife, 20 AUG 1746, Cecil Co., MD
     Probate Court Liber 22, p 371-372; Elizabeth had inherited an estate, and
     John was engaged in settling it. MD law at that time provided that a husband
     was the owner of an estate inherited by his wife.
In JAN 1750, John was a creditor in the state inventory of Thomas Johnson; In
     AUG 1761, he was noted as "next of kin" in an inventory of the estate of John
     Hayes (Abstracts of Inv. of the Prerogative Court,, V.L. Skinner)
John was a bondsman in a number of court actions during 1760-1770, the last
     found was in JUL 1770. (Testamentary Proceedings, Cecil Co., MD Probate
     Court, Liber 43, p 592)
John took his oath of Allegiance to the U.S. in 1778

     "John Stockton married Elizabeth Aldredge on 5 NOV 1745 at St Mary Ann's
Parish, Cecil Co., MD, and resided in that county which borders the PA line,
until his death 12 FEB 1783, John's Will (29 JAN 1783-5 JUN 1783) was probated
in Cecil Co., MD. His son, Joseph, was named executor of the estae. Elizabeth
was born c1715 in PA, and died 3 FEB 1784 in Cecil Co., MD. Issue, John and his
son, Joseph, were church wardens and vestrymen at St Stephens Parish, Cecil
Co., MD for several years at different times.

    and I do hereby will and bequeath all of my personal property unto Richard
    Davis's three daughters Viz. Sarah Davis, Elisa Davis and Ann Davis.  The said
    personal property to be equally divided between the aforesaid three daughters
    of Richard Davis.  Lastly it is my will and desire that Richard Davis of
    Cecil Co., and Sarah Davis of said county be executor and executrix of this my
    last will and testament hereby revoking all former wills and testments in
    witness thereof I have here unto set my hand and seal this 23rd day of March

    Cecil Co. 7 DEC 1819 by Edward Penington.
This would indicate he had no wife or children.  WHO IS RICHARD DAVIS ??
CLIFF NEILSON, 3703 MOSS BROOKE CT., FAIRFAX, VA 22031: Joseph injerited his
     father's lands as legatee and was executor of his father's 1783 Will.  Joseph
     died between 10 MAR 1816 when he wrote his will and 7 DEC 1819 when it was
     recorded. (Cecil Co., MD Will Book GG, p 322).
In 1783, Joseph was taxed as the owner of "Virginity, New Garden, High Park,
     and Abraham's Promise" with 8 white inhabitants. (Newspaper Abstracts of
     Cecil and Hartford Cos 1822-1830, F. Edward Wright, 1984; Notice in Elkton
     Press, 16 AUG 1828, had to do with a sheriff's sale of property, Abraham's
     Choice and New Garden in Sassafras Neck were identified as being formerly
     owned by Joseph Stockton, dec'd)
1790 Cecil Co., MD; Joseph was head of family in Bohemia Hundred/Manor (between
     Bohemia and Elk River) with 3 males over 16, no females and 8 slaves.
1800 Cecil Co., MD; same place; Joseph shown as over 45 with a female over 45
     and 9 slaves.
There were 3 entries during 1788-1790 for Joseph in Cecil Co. land records. The
     first was Power of Attorney from Sampson P. Hyland to Joseph Stockton (not
     researched); Second was Bill of Sale from Joseph Stockton to Elizabeth Davis,
     Cecil Co., MD, Deed Book 16, p 488 (not researched); Third, acting as the
     Executor for Richard, Elizabeth and Sarah Davis, he recorded a "Receipt from
     John Mercer to Joseph Stockton", Deed Book 16, p 521 (not researched)
THESE MIGHT EXPLAIN WHO AND WHY HE LEFT HIS PERSONAL ESTATE TO THE DAUGHTERS OF
RICHARD DAVIS

     "Governor's Register 1674-1851, State of DE", Vol. 1, p 25, Wilmington Star
     Pub., 1926; On 12 MAY 1778, during the Rev. War, Benjamin was appointed
     Commissary of an Independent Co., of Guards to be raised in New Castle Co.,
in his will of 13 OCT 1776, he included the phrase "... now having an
intention to go to the camp at New York..."  He died after his 1778 appointment
and before the wills recording on 22 AUG 1778; In the will he was identified as
being of St. George's Hundred. His legatees were his wife Martha, and sister
Elizabeth Stockton of MD; there was no mention of children.
     Notwithstanding their absence from his will, it was possible that he had a
son and a daughter.  in 1782, four years after his death, his widow, Martha
Stogdon was taxed with a nale and a female less than 18 in the household. (The
Reconstructed DE State Census of 1782, Hancock, p 83).  The children might also
have been servants, or children of a relative.

    army as LT in  one of MD reg., with which he immediately marched to NY. He
    was, it is believed, at the battle of Long Island, and in all subsequent
    actions of note, up to the storming of Ft. Washington where he became a
    prisoner of war. ... when he was exchanged, he found himself outranked in the
    services and resigned his commission. Sometime afterward, he removed to DE and
    remained a citizen of the State until his death in 1822.  Served in DE militia
    with rank of Brig. Gen, commanded the volunteers of DE in War of 1812."

CC NEILSON: served with Capt Joshua George's Co., 18th Batt, as 2nd Lt, on 20
JUL 1776; 5 OCT-12OCT 1776, 2nd Lt, 2nd Reg of Foot, Col. Wm. Richardson's Reg.
    He next appears on a 7 JUL 1777 War Dept. ledger as having received $200 from
    an "account with officers who made their escape from Long Island".  He
    apparently was a Lt. in 7th MD Reg., under John Gunby, located in Wilmington
    on 28 DEC 1777.  However, in AUG 1778, he was entered on a roll as having been
    a prisoner, made his escape from NY, and never joined his reg.  In SEP 1778 at
    White Plains, NY he was entered on the Reg. list as 1st Lt.
     John left MD sometime after SEP 1778 and went to Newcastle Co., DE where he
    was a member of Capt. John Clark's Co., 2nd Reg. DE militia in MAY 1779.  John
    served 9 years in the DE militia during 1807-1816, rising from Lt Col. to Brig
    Gen.  During the War of 1812, John was a principal militia leader, credited
    with being in command when the British landed at the head of the Elk River. He
    resigned 5 MAR 1816.
     John first purchased land in New Castle Co., in 1780; bought 18 parcels
    between 1783-1813; sold 16 parcels between 1783-1814; 5 of the sales between
    1796 and 1818 bore the notation "with wife"; 1784 became a Warden of Immanuel
    (Epsicopal) Church, Wilmington; again in 1790; 5 FEB 1785, appointee as
    trustee of county loan office, charged with redeeming bills of credit issued
    by DE before or since the Declaration of Independence; 5 OCT 1790 appointed
    county sheriff; 26 MAY 1813 appointed by Gov to be a director of the Farmers
    Bank of DE; enumerated on census' 1800, 1810 and 1820
     For many years he lived on a farm about 2 miles from Wilmington on the Hares
    Corner Rd; he also lived in the Bauduy Mansion opposite the Wilmington City
    Hall.
     ABSTRACT OF JOHNS 1819 WILL: "bequeathed to his grandson Stockton
Strawbridge if he survived him and reached 21, his silver tankard and $4000.
Remainder of estate to son, Thomas (included phrase): prior to my last
intermarriage, conveyed to my son Thomas a plantation in Bucks Co., PA. Thoman
and fried James B. Black to be executors. Wtinesses: John Jaunir, Joseph
Roberts, Evan Thomas. (Will of John Stockton of the Hundred and County of New
