This Indenture made this Thirtieth day of Janaury
in the Year of our Lord Christ one Thousand seven hundred and sixty
two Between Michael Kafer of the Parish of Brumfield in the County
of Culpeper and Colony of Virginia of the one Part and John Weaver of
the Parish County and Colony aforesaid of the other Part Witnesseth
that the said Michael Kafer for the Natural Love and fatherly
Affection which he hath and doth bear for his aforesaid Son inlaw
John Weaver and Barbary his wife the Daughter of the said Michael
Kafer and for and in Consideration of the sum of five Shillings in Handpaid
to him the said Michael Kafer the receipt whereof he the said MichaelKafer
doth hereby Confess and Acknowledge himself Satisfied Contented and paid
Have Given Granted Bargain'd Sold Enf__'d[?] and Confirmed unto him
the said John Weaver and Barbara his wife one Certain Tract or Parcel of
Land Situate lying and being in the Fork of the Rapadan and Robinson
Rivers and Contains by Estimation one hundred Acres be the same more
or less and is Bounded as follows (to wit) Beginning at a White oak
and two red Oaks Corner to George Utz in aline of a Patent formerly
Granted to the aforesaid Michael Kafer for four Hundred Acres of Landbearing
Date the fourth day of June one Thousand and seven hundred and twenty
six and runing thence with the line of the said Patent North Ten
Degrees East to a white oak Corner to the said Patent thence with
Another line of said Patent North Sixty five Degrees West to a red Oak
Corner in said Patent, thence North fifteen Degrees East to three red
Oaks Corner to the aforesaid George Utz jun'r thence with the said Utz
Line to the Beginning together with all Houses Outhouses Gardens
fences Meadows feedings ways Waters and Water Courses and all and
Singular the Profits Commodities Hereditaments and appurtenances to
the same belonging in or anywise appertaining To have and to
hold the above mentioned Tract of Land and premises with the appurtenances
unto him the said John Weaver his Hiers and Assigns forever and the said
Michael Kafer for himself his Heirs and Assigns the said Land and premises
with their and every of their appurtenances unto them the said John Weaver
and Barbara his wife shall and will warrant and forever Defend by these
presents.  And the said Michael Kafer for himself his Heirs &c dothfurther
promise Grant and Agree to and with him the said John Weaver his Heirs &
Assigns that at the time of Sealing and Delivery of these presents he has
Good right full power and Lawfull Authority to sell and Dispose of the
same in manner and form aforesaid and that from hence forth the said John
Weaver shall be in the Actual Possession of the said Land and premises
and that the said Land and premises is freely and Clearly Exonerated
Acquited and Discharged of all and all former Sales Bargains Grants
Dowers Gifts will or any other Right or Incumbrance whatsoever
to the aforesaid Land and premises belonging or in any wise appertaining

       In the name of god amen I John Weaver Snr of Madison County do makethis
my last will and testament I do lend my loveing [sic] wife Barbara Weavermy house
and Plantation and five of my slaves such as she chose and yous [sic]  ofmy House such as she
will chose and cattle as many as she will chose and House furniture andplantation
tools during her life  Item my will and desire that my son John WeaverJun shall have
the Land where he now lives on and after the death of my wife he is tohave all the track [sic]
where I and he lives on and them ten acres as I purchast [sic] of PeterWeaver and one
hundred acres of that Track [sic] I purchast [sic] of Jacob Rasor to himand his heirs  Item my
will and desire that my son Aaron Weaver shall have that track [sic] as Ipurchast [sic] of
Henry Crisler and twelve acres of that Track [sic] as I purchasd [sic] ofJacob Rasor and one hun-
dred acres of my mountain Land  Item my will and desire that my son Johnshall
have choice of the track shall have two hundred acres of my Mountain Land

and desire that I give to my daughter Mary Rouse and the heirs of herbody one
Negro Boy named Isaac  Item my will and desire that I give to my daughter
Hannah Blankenbecker and the heirs of her Body and all her Estate to she[sic] heirs
of her body one Negro boy named Ned  Item my will and desire that I giveto my
son John one Negro named Bill  Item my will and desire as my son Aaronshall
have one Negro man named Richard  Item my will and desire that ElizabethBaker shall

have forty pounds out of my Estate  Item my will and desire that thebalance of my
Estate shall be equally divided among my sons and daughters  Item my willand desire
that my son John shall be overseer and manage business for my wife  Itemmy will
and desire that those thing [sic] I lent my loving wife what remainsafter her death all
except the Land that I have willed to my son John Weaver Jun shall beequally divided
among my sons and daughters  Item my will and desire that my Slave Henryshould
be hired out by my Executors whom I shall name hereafter as long as mywife sall [sic] live
Lastly I do nominate and appoint Cornelius Carpenter and my son JohnWeaver
Jun Executors of this my will and I do hereby revoke and disannull allother wills
by me heretofore made declaring this only to be my last will and Testament

A Codicil to this my last will, after my death and the death of my sonJohn my
desire is that he the said John shall pay each of my said daughters,Margaret, Mary
& Hannah Ten pounds each.
My will and desire is that my Negro woman Nell at my death shall go to my
son Aron [sic] if the other children is Satisfied.

At a Court held for Madison County the 23rd day of April 1807.
       The Last will and testament of John Weaver Sen deceased wasexhibited into Court
and proved by the oaths of Adam Utz J and William Wilson two of theSubscribing
witnesses thereto and ordered to be Recorded and on the motion of JohnWeaver one of
the Executors therein named Certificate is granted him for obtaining aprobat [sic] thereof
in due form.  Whereupon he qualified and gave bond and Security accordingto Law.

Know all men by these presents that we John Weaver Adam Wayland and
Michael Yager are held and firmly bound unto Merry Walker, Daniel FieldJohn
Hume Daniel James and William Mallory, Gentlement Justices of the Courtof Madison
County now sitting in the sum of Ten thousand dollars to the paymentwhereof well
and truly to be made to the said Justices and their Successors we bindourselves and
each of us, our and each of our heirs executors and administrators,Jointly and severally
firmly by these presents, sealed with our seals this 23rd day of April inthe year of our
lord 1807 and in the 31st year of the Commonwealth.
       The condition of the above obligation is such that if the abovebound John Weaver
Executor of the last will and testament of John Weaver Sen deceased domake or cause
to be made a true and perfect Inventory of all and Singular the goods,chattels and credits
of the said deceased, which have or shall come to the hands possession orknowledge of him
the said John Weaver or into the hands possession or knowledge of anyother person or
persons for him and the same so made do exhibit, or cause to be exhibitedin the County
Court of Madison at such time as he shall be thereunto required by thesaid Court.
and the same goods chattels and credits, and all other the goods chattelsand credits
of the said deceased, which at any time after shall come to the handspossession or
knowledge of him the said John Weaver or into the hands or possession ofany other
person or persons for him do well and truly administer according to Lawand further
do make a Just and true account of all his actings and doings therein,when there
unto required by the said Court, and also shall well and truly pay anddeliver all
the legacies Contained and Specified in the said Testament as far as thesaid goods, chattels
and credits will thereunto extend, and the law shall charge, then thisobligation to be

void and of no effect, else to remain in full force and virtue
