5. Berkeley Co Wills extract: In the Name of God Amen, I, Moses Tullis, of
Berkeley County in the Colony of Virginia, being sick of body but of perfect
and sound memory, thanks to Almighty God for his mercies, and calling to mind
the uncertain state of life in this world, that all flesh must once die, there-
fore do think proper to dispose of such wordly substance as it pleased God to
possess me of at present, in manner and form following; that is to say I order
my body to be decently intered in such place as shall be thought most
convenient and that all my just debts as I owe in right conscience to any
manner persons or persons be firstly paid by my executors hereafter named
within convenient time after my decease. And now for my worldly affairs. First
I leave my beloved wife Mary Elizabeth one third part of all my plantation and
my bed and furniture and the mare she commonly rides, with saddle and bridle,
and one third part of all cows, horses (one colt excepted), sheep, hogs,
implements of labour household furniture and crops now growing. Secondly I
leave to my beloved son Aaron Tullis the sorrel colt and all and every of the
remaining two thirds of the land and other goods. I order to be sold by my
executors and equally divided to each of my children an equal part or share,
and at my wife's decease, I order her third share of the plantation to be sold
and an equal division of it to be made to all my children then living, or to
their heirs. This I make, constitute, and ordain to be my last will and
testament, disannulling all other will or wills by me heretofore made either by
word or write. I constitue Timothy Jewell, my son in law, and Aaron Tullis, my
son, both of Berkeley County in Virginia, to be my whole and sole executors, to
see this, my last will and testament duly and truly executed, according to the
best of their skill and conscience, within convenient time after my decease. In
Witness whereof I have hereunto set my hand and seal this tenth day of June,
1777, Moses Tullis (signed).
Properly signed by the testator being truly read before in the presence of
us, Moses Tullis, Jonathan Tullis, John Loan.
At a court held for Berkeley County the 21st day of October 1777, this the
last will and testament of Moses Tullis, deceased, was proved by the oaths of
Johnathan Tullis and John Loan, two of the witnesses thereunto, and ordered to
be in office. And at a court held for the said county the 18th day of November
1777, this said will was presented in court by Timothy Jewell and Aaron Tullis,
the executors therein named, who made thereto according to law, and the same is
admitted to record and on the motion of the said executors who entered into
bond with John Wright and Peter Pourr their securities, in the penalty of Five
hundred pounds, conditioned for their true and faithful administration of the
said estate certificate is granted them for obtaining a probate thereof in due
form of Law. Test witt David S. Crow.

At a court held for Berkeley County the 20th day of March, 1781, this
inventory and appraisement of the estate of Moses Tullis, deceased, was
